How Australian Law Protects Your Core Superannuation from Mortgage Foreclosure
The biggest fear many Australians have when considering property inside super is risk: 'What happens if the property market crashes, the tenant defaults, or interest rates spike? Can the bank seize my superannuation cash or ETF balances?'
Under standard personal property investing, banks require unlimited personal guarantees and can pursue your personal home, savings, and assets. But inside super, Australian law creates an impenetrable barrier through the Limited Recourse Borrowing Arrangement (LRBA).
Codified in Section 67A of the Superannuation Industry (Supervision) Act 1993, an LRBA mandates that if your SMSF defaults on its property mortgage, the lender's recovery rights are limited entirely to that single asset. They are legally barred from touching any other cash, shares, or property held within your super fund.
Here is our strategy: We ask you a few quick questions about your situation, then match you directly with an accredited specialist who will fight for your approval, cut through bank red tape, and deliver your loan with zero stress. 1. Section 67A of the SIS Act: The Golden Rule of SMSF Lending
Section 67A creates a rigid legislative exemption to the general prohibition against borrowing in superannuation. To qualify as a compliant LRBA, four conditions must be met:
1) The borrowed money must be used to acquire a single acquirable asset; 2) The asset must be held on trust (the Bare Trust) so that the SMSF trustee acquires beneficial interest; 3) The SMSF must have the right to acquire legal ownership after making loan repayments; and 4) Any lender recourse against the SMSF trustee must be limited to the mortgaged asset.
2. Director Guarantees in Modern Non-Bank SMSF Lending
While the LRBA legally shields your SMSF's other assets, non-bank lenders usually require the directors of the Corporate Trustee to provide a limited personal guarantee.
- What the guarantee covers: It ensures that directors cannot simply walk away from a property during a downturn without lender consultation.
- What the guarantee CANNOT touch: It cannot breach SIS Act rules by enabling the lender to seize other superannuation holdings inside the SMSF.
- Independent Legal Advice (ILA): Non-bank lenders require you to obtain an IA certificate from an independent solicitor confirming you understand the LRBA structure.
3. Unwinding the LRBA at Final Loan Repayment
Once the SMSF mortgage is completely repaid, the Bare Trust has fulfilled its legal duty. The trustee can either dissolve the Bare Trust and transfer the legal title directly to the SMSF Corporate Trustee or leave the holding structure in place.
In most Australian states, transferring the property from the Bare Trustee to the SMSF Trustee attracts nominal stamp duty ($20–$50) provided the original deeds were stamped correctly at acquisition.
